Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Kerux (the “Service”; also “Kerux,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.
1. The Service
Kerux is a customer-support helpdesk that turns inbound email into tickets and lets your team — and, at your option, an AI model you connect — respond to them. Kerux follows a “bring your own AI key” model: you supply your own AI provider credentials, and we do not mark up or resell AI usage.
2. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and keep it up to date. You must be at least 18 years old to use the Service.
3. Your AI Keys and Data
You retain ownership of the AI provider keys you connect and of the customer data you process through the Service. You are responsible for your use of any third-party AI provider, including its terms, costs, and outputs. AI-generated responses may be inaccurate; you are responsible for reviewing communications sent to your customers.
4. Acceptable Use
You agree not to use the Service to:
- violate any applicable law or regulation;
- send spam, phishing, or unsolicited bulk messages;
- infringe the intellectual property or privacy rights of others;
- upload malware or attempt to disrupt or gain unauthorized access to the Service;
- resell or provide the Service to a third party except as expressly permitted.
5. Fees and Billing
Paid plans are billed per agent seat on a monthly or annual basis through our payment processor. Fees are charged in advance and are non-refundable except where required by law. You authorize us and our payment processor to charge your payment method for all applicable fees. We may change pricing on a prospective basis with notice.
6. Intellectual Property
The Service, including its software, design, and content (excluding your data), is owned by Kerux and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription.
7. Termination
You may cancel at any time. We may suspend or terminate your access if you breach these Terms or use the Service in a way that creates risk or legal exposure for us or others.
8. Disclaimers
The Service is provided “as is” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.
9. Limitation of Liability
To the maximum extent permitted by law, Kerux will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data. Our total liability for any claim arising out of the Service will not exceed the amount you paid us in the twelve months before the event giving rise to the claim.
10. Export Controls and Sanctions
Kerux is operated from the United States and is subject to U.S. export-control and economic-sanctions laws. You represent and warrant that you are not located in, ordinarily resident in, or organized under the laws of, and that you will not access or use the Service from or on behalf of any person or entity in, any country or region subject to comprehensive U.S. sanctions — including Cuba, Iran, North Korea, Syria, and the Crimea, Luhansk, and Donetsk regions. You further represent that you are not identified on any U.S. government restricted-party list, including the U.S. Treasury Department’s Office of Foreign Assets Control (OFAC) list of Specially Designated Nationals. You agree not to use the Service in violation of any applicable export-control or sanctions law.
11. Privacy
Our Privacy Policy describes what personal data we handle, the subprocessors we use, and how to request export or deletion of your data. It is incorporated into these Terms by reference.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Florida, and you consent to their jurisdiction and venue. Where a mandatory consumer law of your country of residence grants you rights that cannot be waived by contract, nothing in this section limits those rights.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice (for example, by email or in-app). Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
